Petitioner is aggrieved by the fact that in spite of informing the police authorities no steps have been taken. According to the petitioner they have filed a complaint case being CR No. 412/2024. The accusations made in the complaint were to the effect that the private respondents barged into the property and thereafter ransacked the house, assaulted and molested the wife of the petitioner as also the child was not spared. The said complaint case is pending before the learned CJM, Tamluk.
Mr. Manna, learned advocate submits that the narration of facts as has been made by the petitioner are devoid of any truth.
State has submitted a report. Report reflects that earlier on the basis of the complaint of private respondent, namely, Badal Shaw, Kolaghat PS Case No. 775/2024 was registered for investigation and on completion of investigation charge sheet has been submitted by the police authorities.
In view of the police report it is reflected that the petitioner and the private respondents are at loggerhead. The petitioner and his family members apprehend that he may be subjected to further harassment.
In view of the apprehension of the petitioner and that the police authorities have already drawn up a proceedings under section 126 of the BNSS against the petitioner, and since the nature of the dispute is absolutely a private dispute and the parties are contesting amongst each other in different forum, I direct that in case any representation is made to the Officer-in-Charge of Kolaghat Polcie Station thereby expressing insecurity to the life and liberty, in that case, the Officer-in-Charge of Kolaghat Police Station would ensure that no untoward incident results because of the strained relationship existing between the parties.
With the aforesaid observations WPA 10072 of 2025 is disposed of.
The observations made above are for the restricted purpose of disposing of the present writ petition and if the parties approach the civil court, the civil court will independently deal with the same without being influenced by any observation made above.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
