Mr. Lakshminath Bhattacharya … for the petitioner Mr. Kanak Kiran Bandyopadhyay … for WBSEDCL The petitioner seeks a domestic electricity connection for his residential premises located at Plot No. 167, Mouza–Dakshin Amratala, Police Station–

Mandir Bazar, District–South 24 Parganas.

Learned counsel appearing for respondent nos.

11 and 12 submits that they are also joint owners of the said property.

It appears from the records that Plot No. 167 is jointly owned by the petitioner and respondent nos. 11 and 12. The petitioner’s possession over a portion of Plot No. 167 is not disputed. It is also admitted that respondent nos. 11 and 12 are in possession of another portion of the same plot and are already availing of an electricity connection. However, the petitioner is yet to be provided with an electricity connection.

In view of the above, respondent nos. 11 and 12 cannot reasonably object to the petitioner obtaining an independent electricity connection for his portion of the said premises.

It further appears that there exists a common pathway which is intended to be used by the West Bengal State Electricity Distribution Company Limited (WBSEDCL) for laying electricity wires. The decree of the Civil Court dated June 29, 1988, passed by the learned Munsif, 3rd Court, at Diamond Harbour in Title Suit No. 367 of 1987, affirms that the said pathway is to be jointly used by the petitioner and respondent nos. 11 and 12.

In light of the foregoing, no impediment can be raised to prevent WBSEDCL from drawing electricity wires over the said pathway.

Accordingly, WBSEDCL is directed to effect the electricity connection at the premises of the petitioner within a period of three weeks from the date of communication of this order, subject to the

The Officer-in-Charge, Mandir Bazar Police

Station, shall extend necessary assistance to the

officials of WBSEDCL for the implementation of this

order, at the cost of the petitioner.

It is made clear that the grant of electricity connection shall not confer any right, title, or interest in the property in favour of the petitioner.

Accordingly, WPA 10875 of 2025 is disposed of.
