Petitioner is aggrieved by the fact that inspite of cognizable offences having been committed and the same being informed to the police authorities, no action has been taken and as such the petitioner was compelled to approach this Court.
State has submitted a report. Report reflects that over the written complaint dated 04.12.2024 Namkhana Police Station case no. 177/24 dated 31.12.2024 was registered for investigation and on conclusion of investigation charge-sheet has been submitted before the Over the complaint dated 31.01.2025 another case being Namkhana Police Station case no. 14/25 dated 31.12.2024 was registered for investigation and on conclusion of investigation charge-sheet has also been that there was no deficiency on part of the police authorities to address the grievance of the petitioner.
Learned advocate for the petitioner subsequently submits that because of the pendency of the criminal cases petitioner is being threatened to withdraw the same at the behest of the accused persons who are influential persons of the locality.
In view of the petitioner and/or his family members being witnesses to the criminal cases, I direct that in case an application is taken before the jurisdictional Magistrate for necessary protection, the learned Magistrate will call for a Threat Perception Report from the police authorities and thereafter assess and pass necessary directions under the Witness Protection Scheme, 2018.
In the meantime police authorities would ensure that further untoward incident should not result because of the strained relationship presently existing between the petitioner and the private respondents.
With the aforesaid observations WPA 1611 of 2025 is disposed of.
Report so submitted by the State be kept with the record.
A copy of the report be handed over to the learned All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
