2025 Supreme(Online)(Cal) 10550

CALCUTTA HIGH COURT
AMIT DOLUI – Appellant
Versus
CALCUTTA ELECTRIC SUPPLY CORPORATION LIMITED AND ORS. – Respondent
WPA 4472 / 2025

Sl. No.33

17.04.2025 Suman Ct. 15 WPA 4472 of 2025 Amit Dolui Vs.

Calcutta Electric Supply Corporation and Ors.

Mr. Pradip Kumar Kundu ..for the petitioner Mr. Debanjan Mukherjee ..for CESC Mr. Victor Chatterjee Ms. Manali Mazumder ..for respondent nos. 6 and 7.

The petitioner seeks an electricity connection for Flat No. 1C, First Floor, 17/18/1, Sashi Bhusan Shankar Lane, Salkia, Golabari, Howrah.

The petitioner submits that he has paid the consideration amount for the purchase of the said flat, and as such, he is entitled to obtain a separate electricity service connection for the premises.

Respondent no. 6, who is the mother of the petitioner, submits that an electricity meter is already installed in her name in the said flat and that the petitioner is currently availing electricity through the said connection. It is her contention that two separate connections cannot be provided for the same flat.

It is further submitted by respondent no. 6 that she also resides in the said flat. However, this submission is denied by the petitioner, who asserts that respondent no. 6 resides in the flat only occasionally.

Having considered the submissions of both parties, I am of the view that there is no justification for granting an additional electricity connection for the same flat when a functional connection already exists and is being used by the petitioner.

It is made clear that the grant or denial of an electricity connection does not confer any right, title, or interest in respect of the property. The existence of an electricity meter in the name of the petitioner’s mother does not establish any ownership or legal claim over the flat. Similarly, even if a separate connection were to be granted to the petitioner, it would not create any equitable right or interest in the property.

In view of the admitted position that the petitioner is currently availing electricity through the existing meter, I do not find any ground to entertain the petitioner’s prayer for a separate connection in respect of the said flat.

Accordingly, WPA 4472 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
