The matter is pending since 2011 and it pertains to an application under Section 125 of the Code of Criminal Procedure filed by the wife/petitioner, whose claim for maintenance for herself and her minor daughter has been refused by the learned trial Court. Therefore, this Court is of the view that the matter should be taken up for hearing in absence of the opposite parties.
5. The instant application under Article 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 is directed against the order dated 4th August, 2008 passed by the learned 1st Judicial Magistrate, Barasat, North 24 Parganas and the order dated 28th
