The petitioner is aggrieved by the series of incidents which included amongst others an assault being inflicted upon him and his father by the respondent no.4.

It was also alleged that they were threatened for withdrawing the case pending before the Hon’ble High Court, Calcutta and the incident was informed to the local police station but, in spite of receipt of the said information, no steps have been taken by the concerned police authorities.

Learned advocate for the State submits a report which reflects that Howrah P.S. Case No. 116 of 2025 dated 19.03.2025 has been registered for investigation under the relevant provisions of BNS.

In view of the petitioner expressing apprehension of being threatened and/or assaulted, I direct that since a criminal case has already been registered and the learned jurisdictional Court is already in seisin of the issues, the petitioner would be at liberty to approach the jurisdictional court under the relevant provisions of Witness Protection Scheme, 2018.

In case, such application is filed, the learned Magistrate would call for a threat perception report, thereafter, pass necessary order(s) in accordance with law.

With the aforesaid observations, WPA 5359 of 2025 is disposed of. Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
