It appears that the intending proposed proforma respondents have tried to represent themselves under representative capacity on behalf of the villagers of village – ‘Pardi’, under Police Station Jhalda, District – Purulia. It also appears that the application being CAN
1 of 2025 is filed not in accordance with the provision under Order 1 Rule 8 of the Code of Civil Procedure. Hence, the application being CAN 1 of 2025 is disposed of with a liberty to the applicants to file it afresh.
Re: WPA No.2841 of 2025 Affidavit of service filed on behalf of the petitioner is taken on record.
It appears to this Court that the instant writ petition cannot be disposed of without giving the appropriate opportunity to the parties to exchange affidavits.
Let the private respondents as well as the State respondents be given liberty to file affidavit-in- opposition and a report in the form of affidavit respectively, within three weeks from date. Reply/exception, if any by the petitioner, shall be filed within two weeks thereafter.
Let the matter appear in the list in the 1st week of May, 2025.
Supplementary affidavit filed on behalf of the petitioner is taken on record. The private respondents want to file affidavits against the said supplementary affidavit.
Let such affidavit be filed within three weeks from date.
