Affidavit of service and supplementary affidavit filed by the petitioners be kept with the record.

Petitioners are aggrieved by the inaction of the police authorities as some of the employees are disturbing the ambience of the hospital and to that effect, they have approached the learned Executive Magistrate and also repeatedly informed the police authorities for taking appropriate action. Petitioners complain that there has been slogans at the behest of the employees as also postering inside the hospital being Marwari Relief Society.

State has submitted a report. Report reflects that in respect of the dispute and difference between the petitioners and the private respondents number of litigations are pending including criminals cases as also litigations to the industrial dispute before the Labour Commissioner. However, the report of the State reflects that there has been no obstruction in the egress and ingress as also no complaints from the patients who have been treated. Police authorities have been keeping a strict vigil over the law and order situation.

In view of the circumstances prevailing, I direct that the police authorities would continue their surveillance and ensure that there is no breach of the peace and/or tranquility taking place. Police authorities would communicate with the agitators that in case they have to form a cluster of persons for raising slogans, the same should be outside the hospital premises without disturbing the egress and ingress of the patients.

With the aforesaid observations, WPA 5399 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
