1. This revisional application has been filed challenging the order and judgment dated 14th March, 2023 passed by the Learned Chairperson, Debts Recovery Appellate Tribunal, Kolkata, whereby Learned Appellate Tribunal allowed the appeal against the order passed by the Debts Recovery Tribunal with respect to restoration of the physical possession of the property to the borrower which was set aside and rest operative portion of the order passed by the Learned Debts Recovery Tribunal was confirmed. Being aggrieved by the said order the instant revisional application has been filed.

petitioner/bank has submitted that entire outstanding money has already been liquidated to the loan account after selling the property.

3. However, considering all the facts and circumstances, the revisional application stands admitted.
