In spite of service, opposite party Nos. 5 and 6 are not represented.

This is an application wherein the petitioner has sought for transfer of the proceeding, being Probate Case No. 190 of 2014 from the Court of learned Additional District Judge, Purba Burdwan to the Court of learned District Judge, Paschim Burdwan at Asansol.

Learned Counsel appearing on behalf of the opposite party No. 1 and learned Counsel appearing on behalf of the opposite party Nos. 2, 3 and 4 submit on instruction that the representing opposite parties do not have any objection if the aforesaid prayer for transfer made by the petitioner is allowed.

The application, being C.O. 3877 of 2024 is hereby allowed on consent.

Learned District Judge, Purba Burdwan is hereby directed to withdraw the Probate Case No. 190 of 2014 from the Court of learned Additional District Judge, 5^th Court Burdwan and to transmit the same for disposal to the Court of learned District Judge, Paschim Burdwan at Asansol within a period of thirty days from the date of communication of this order.

The transferee Court shall hear the aforesaid proceeding from the stage where it reached till date. The transferee Court shall hear the matter after serving notice upon both the parties intimating the next date of hearing.

Urgent photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities.
