JUDGMENT :

1. This revisional application is directed against an order dated February 10, 2026 passed by the learned Additional District Judge, 10^th Court, Alipore in Act VIII Case No. 59 of 2018 whereby the petitioner’s application under Section 151 of the Code of Civil Procedure, 1908 (hereafter “the Code”) praying inter alia for interim custody of a minor child during all weekends, half of all school vacations, special school holidays and all special occasions of the child, including but not limited to occasions like birthday till the final adjudication and disposal of the said Act VIII case has been rejected.

2. The petitioner has instituted ActVIII Case No. 59 of 2018 praying inter aliafor custody of his minor child. In the said case, the petitioner had filed an application under Section 12 of the Guardians and Wards Act, 1890 (hereafter “the 1890 Act”) which was disposed of by an order dated April 12, 2023. The said order was carried in revision before this Court by filing C.O. 2501 of 2023.
