ORDER (ORAL)

Hon’ble Mr. R.N. Singh, Member (J)

In the present OA, the applicant, a retired Trained Graduate Teacher (Natural Science) herein after referred to as TGT, has prayed for the following reliefs :

(a) directions to the respondents to grant applicant 2nd upgradation w.e.f 01-09-2008 & 3rd financial upgradation w.e.f 1-02-2011 after ignoring the below benchmark ACRs which are never communicated to the Applicant as per the law laid down by the Hon'ble Apex court with all the consequential benefits.

b) Direction to the respondents to pay cost of litigation to the Applicant as the Applicant has been dragged to the Tribunal by the respondents.

c) Any other order as this Hon'ble Tribunal may deem fit under the present facts and circumstances of the case.

2. The claim of the applicant has been contested by the respondents by filing a counter reply wherein they have prayed for dismissal of the OA. The applicant has filed rejoinder reiterating his case and the grounds pleaded in support thereof.

3. We have heard the learned counsels for the parties and with their assistance, we have also perused the pleadings available on record.
