ORDER

Hon’ble Mr. Manish Garg, Member (J) :

In the present OA filed under Section – 19 of the Administrative Tribunals Act, 1985 , the applicants have prayed for the following reliefs:

“(i) Quash and set aside the OM dated 26.10.2015 (Annexure- A-1)

(ii) direct the respondent to continue to pay the transport allowance to the applicants while remaining in Faridabad at the rates applicable to Delhi.

(iii) may also pass any further order(s), direction(s) as be deemed just and proper to meet the ends of justice.”

2. Highlighting the facts of the case, learned counsel for the applicants submitted that the applicants, 76 in number, are employed in the office of respondent No. 4 in various capacities and are aggrieved by the office memorandum dated 26.10.2015, which seeks to restrict their Transport Allowance to the rates applicable to "other places".

2.1. Learned counsel for the applicant further submitted that the applicants are entitled to Transport Allowance at par with Central Government employees working in Delhi as per the office memorandum dated 05.11.1974.

2.2. Learned counsel highlighted that the classification of cities for the purpose of House Rent Allowance (HRA) and City Compensator
