ORDER

1. The SWP/WP(C) No. 1117/2012 was transferred from the Hon’ble High Court of Jammu and Kashmir at Jammu and was registered as T.A. No. 61/6798/2021 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court with following prayer:

a) “Writ, order or direction in the nature of Writ of Certiorari quashing Government Order No:190-GAD of 2012 dated 13^th February, 2012 whereby the petitioner has been retired from service prematurely by the government in exercise of power under Article 226(2) of the J&K Civil Services Regulations w.e.f. F.N. of 13^th February, 2012;

b) Writ, order or direction in the nature of Writ of Mandamus commanding the respondents to treat the petitioner in service w.e.f. 13^th February, 2012 and to release in favour of the petitioner all consequential benefits including the salary;

c) Any other writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, may also be granted in favour of the petitioner and against the respondents along with cost.”
