ORDER

1. The SWP/WP(C) No. 3748/2019 was transferred from the Hon’ble High Court of Jammu and Kashmir at Jammu and was registered as T.A. No. 61/154/2024 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court with following prayer:

a) “allow the present writ petition;

b) quash Communication bearing No. SMVDU/Adm/ Estt. / 19/6568 dated 16.09.2019, whereby and where under, the promotion of the petitioner as Associate Professor has been kept subject to an "Undertaking" by the petitioner, which "Undertaking" contains illegal clauses and for all future times, closes the doors of the petitioner for agitating his grievances before the appropriate / competent authority;

c) quash Seniority List of Faculty Members at SMVDU issued under Notification No. SMVDU/Adm/Estt./ 19/ 0934-35 dated 7^th February, 2019, to the extent, the private respondent, who was appointed more than 07 months after the appointment of the petitioner as Assistant Professor in the respondent University, was placed at S. No. 36 of the Seniority List against the post of Associate Professor and the petitioner at Sr. No. 40 as Assistant Professor;
