ORDER

PRAMOD KUMAR DAS, MEMBER (A):

    The case of the applicant in brief is that while working as O.S., he was served with the memorandum of charge dtd.

30.11.2009/07.12.2009 for unauthorized absence from 21.08.2009. Inquiry Officer conducted inquiry and found the charges proved. Disciplinary Authority passed the order of “dismissal from service” vide order dated 31.07.2012. Appellate Authority vide order dated 06.03.2013 rejected the appeal of the applicant confirming the punishment. Being aggrieved, applicant approached this Tribunal in OA No. 302/2014, which was disposed of vide order dated 23.08.2016 (A/1) with the following directions: <br/>

    "8. The OA is allowed in part. The order passed by the Disciplinary Authority dated 31.07.2012/01.08.2012 [Annexure-

8] and Appellate Authority dated 06.03.2013 [Annexure-11] are set aside. The matter is remitted to the Appellate Authority to re-consider the case of the applicant only on the question of quantum of punishment and to pass a fresh order except major punishment . The exercise be completed within a period of one month from the date of passing of the order. Since the applicant is out of job, he may be r
