1. That the above titled Transferred Application had been initially filed by the applicant as a writ petition before the Hon’ble High Court of Jammu and Kashmir at Jammu as SWP No. 419/2016 seeking the following reliefs:

i) Writ, order or direction in the nature of Writ of Certiorari quashing the Government Order No. 145-PDD of 2014 dated 02.07.2014 only to the extent its orders appointment of the petitioner as Junior Engineer (Electrical) Grade-II with immediate effect instead of ordering the appointment of the petitioner retrospectively w.e.f 22.08.2009 i.e. the date when other selected candidates pursuant to advertisement notices dated 19.11.2007 and 14.07.2008 were appointed;

ii) Writ, order or direction in the nature of Writ ofMandamus commanding the respondents to give retrospective effect to the appointment of petitioner as Junior Engineer (Electrical) Grade- II w.e.f. 22.08.2009 i.e. the date when other selected candidates pursuant to advertisement notices dated 19.11.2007 and 14.07.2008 were appointed and to accordingly fix the seniority and other consequential benefits of the petitioner;
