ORDER

PER HON‟BLE MRS. SHALINI MISRA, ADMINISTRATIVE MEMBER The applicant has filed this OA seeking the following relief:

“To declare the action of the respondents not processing to pay the balance amount of Rs.6,75,474/- (Rupees Six Lakh Seventy Five Thousand Four Seventy Four only) out of total expenditure of Rs.8,73,570 medical expenditure incurred by him for survival of his life under covid treatment as highly illegal, arbitrary and violation of the Constitution as well as statutory obligation and Articles 14 and 21 of the Constitution of India and the Rules under the proviso to Article 309, and direct the respondents (i) to pay the pending medical claim of a sum of Rs.6,75,474/- along with future appropriate interest within a reasonable time to be fixed by this Tribunal, (ii) by an appropriate order or direction, the applicant may kindly be awarded compensation of Rs.50,000/- as cost of harassment caused to him by the respondents, (iii) any other appropriate order or direction, which this Tribunal may deem fit, just and proper in the facts and circumstances of the case.”
