, the applicant had approached the Hon’ble High Court of Jammu & Kashmir by filing SWP No. 116/2018, which was later transferred to this Tribunal on account of reorganization of State of Jammu & Kashmir into Union Territory of Jammu and Kashmir and Union Territory of Ladakh and registered as T.A. No. 3517 of 2020.

2. Brief fact of the case is that the applicant was appointed by the Competent Authority as VLW under SRO 43 in the year 1997 and is drawing a grade of Rs. 1350-4100 and on 30.11.2016 was posted as VLW in Block Rajgarh, Ramban.

Vide Order No.49 ACDR of 2016 dated 30.11.2016 (Annexure A) was suspended by Assistant Commissioner, Development Ramban (Respondent No.3) on the allegation of fraudulently drawing money from official account. It has been averred that the Assistant Commissioner is not appointing authority of the applicant nor he has competence / jurisdiction to pass the suspension order.
