Against the order of recovery dated 24.08.2004, applicant initially filed SWP No. 65/2007 before the Hon’ble High Court of J&K at Jammu, which on transfer to this Tribunal has been numbered as T.A. No. 9210/2020 and against the recovered amount of Rs. 3,40,410, applicant filed SWP No. 796/2014 before the Hon’ble High Court of J&K at Jammu, which too on transfer to this Tribunal was numbered as T.A.
No. 9096/2020 and by now pleadings in both the cases are complete.
2. Being aggrieved, the applicants have filed the present Transfer Applications, seeking the following reliefs: -
i. Writ of mandamus commanding upon the respondents to pay back to the petitioner the amount which has been illegally recovered from his salary along with interest at the market rate;
ii. Further Writ of mandamus commanding upon the respondents not to effect any recovery from the petitioner about the pilferage of Sarbagga Store in view of his acquittal in the trial with regard to the said allegation;
iii. Further writ of mandamus commanding upon the respondents to grant all the service and monetary benefits to the petitioner which have been withheld on a
