The grievance of the applicant as expressed in the present OA is with respect to his claim for Third Financial Upgradation under the MACP scheme which has been denied to him vide an order dated 09.12.2010.
2. By virtue of the present OA, he has made the following specific prayer:
a) That the Respondent Corporation be directed to grant 3rd ACP/ financial Upgradation to the applicant as provided in the as per para no 28 (A) of MACP Scheme wef
01.09.2008 with all consequential benefits.
b) Any other orders that it deems fit in interest of justice.
3. The applicant had approached this Tribunal ventilating his grievance in an earlier round of litigation in OA No. 2199/2013 which was dismissed vide order dated 16.04.2019, leaving it open to the applicant to seek recourse to appropriate remedy in accordance with law, depending upon the outcome of the SLP which was pending in the Hon’ble Supreme Court on the subject. The SLP had been filed by the present respondents placing challenge to the judgement of the Hon’ble High Court of Delhi in Writ Petition 11826/2016.
