ORDER

1. The present Origional Application has been filed by the applicant against the Government Order No. No.3/Admn/B-

8/PN-0091/10360 dated 13.10.2020 issued by the respondent department.

2. Brief fact of the case is that applicant solemnized marriage with Eknath Londe S/o Atma Ram Londe R/o 1/3, Netaji Nagar, Pune, Maharastra in accordance with Hindu customs, rites including Sikh rituals and rites on 21st day of May, 2009. Unfortunately during that time Eknath Londe did not keep good health and was diagnosed to be suffering from Cancer and for the purpose of his treatment the husband of the applicant was sent to Pune for treatment where he expired on 13-05-2013. The applicant filed a civil suit for declaration declaring her to be the legal heir entitled to receive service benefits, pension and other ancillary benefits of the deceased husband of the applicant Eknath Londe. The Learned Court of 3rd Civil Subordinate Judge (Excise Magistrate), Jammu vide Judgment and decree dated 28-02-2017 declared the applicant to be legal heir of the deceased Eknath Londe who is entitled to receive pension and other ancillary benefits arising out of the death of the deceased Eknath Londe.
