ORDER

Hon’ble Mrs. Harvinder Kaur Oberoi, Member (J):

Learned counsel for the applicant submitted that the applicant, who is an aspirant to the post of Assistant Public Prosecutor (APP), participated in a selection process initiated by the UPSC in pursuance of an advertisement dated 22.01.2021. The applicant applied under the OBC category and has cleared the written examination. While he was awaiting a call for the interview, he has received a communication dated 27.10.2022, whereby his candidature has been cancelled.

2. Aggrieved by the same, the applicant has preferred this Original Application and seeks interim relief and by a detailed order dated 05.12.2022 coordinate bench of this Tribunal has grant interim stay in favor of the applicant, relevant para of the order dated 05.12.2022 reads as under:-

It is not in dispute that the applicant is possessing OBC Certificate of outside Delhi and his caste ‘Sunar’ has been recognized as OBC by the respondents as well. It is seen that certain candidates who participated in the same selection process were denied age relaxation by the respondents, thoughfor different reasons, have approached the Hon’ble High court of Delhi in W.P.(C) No. 937
