2. The applicant filed the OA challenging the Memorandum dt. 10.02.2016 and the action of respondents in not including his name in the eligibility list for promotion to the post of Inspector (Preventive Officer) by applying the maximum age limit condition under Note 2 in Col. 12 in the Schedule to the Customs Department Inspector (Preventive Officer) (Group ‘C’) Post Recruitment Rules, 2002. He seeks a direction to the respondents to consider his candidature for promotion as Inspector in the DPC held for 2015 vacancy without applying the said provision.
3. Brief facts are that the applicant joined the respondents organization as Sepoy in 1996 and was promoted as LDC on 18.3.2004. Thereafter, though applicant qualified in the departmental exam held for the post of Tax Assistant in 2006, he was promoted to the said post on 4.4.2012 with a delay of 3 years, since an LDC is eligible to be considered for the post of Tax Assistant (for short TA ) after rendering 5 years of service.
