1. The present Original Application under Section 19 of the Administrative Tribunals Act, 1985 is directed against action of the respondents in not appointing the applicant as Health & Malaria Inspector Grade-III and not considering him eligible despite having qualified in the written test and is in the merit. His candidature has been rejected by the respondent no.2 vide letter dated 27.07.2020( Annexure A-1).
2. By filing the present Original Application, the applicant has sought a direction to be issued to the respondents to issue appointment letter to the applicant for the post of Health & Malaria Inspector Grade-III as per his merit from the same date it has been given to the similarly placed employees on the basis of same selection with all benefits.
3. The factual matrix of the case at hand is that the applicant joined the Indian Army on 02.08.1988 and retired as Subedar on 01.09.2018. His date of birth is 02.12.1971. The Army Authorities, via letter dated 04.12.2019, clarified that the Graduation Certificate issued by Armed Forces Medical Services (AFMS) is generalized and does not specify subjects.
