ORDER

1. The applicant through the medium of aforesaid Original Application has invoked the jurisdiction of this Tribunal for seeking following relief: -
“a) Quash the Clarification/Advisory bearing No.HME/ Acctts/36/2020 dated 21.01.2021 issued by Director Finance J&K Government Health and Medical Education Department whereby it is clarified that the doctors who have obtained PG degree during service are entitled to First Time Bound Promotion after 07 years of service after acquiring the PG degree.
b) Quash endorsement No.DISM/Est/13808/11 dated 16.02.2021 forwarded by Director ISM J&K to all the DDO’s for strict adherence of the Advisory dated 21.01.2021 and to take appropriate action under intimation to the Directorate.
c) Prohibit the respondents from making any recovery on account of aforesaid Advisory dated 21.01.2021 and endorsement dated 16.02.2021.
d) Any other relief which the Hon’ble Tribunal may deem fit and appropriate in the facts and circumstances of the case.”
2. Facts of the case: -
(i) Vide Govt. Order No.595-HME of 1988 dated 22.07.1988 the time bound promotion scheme was introduced in the Health Services Departme
