South Eastern Railway – Respondent
O.A./866/2023
Mr. Arpa Chakraborty, Counsel; Mr. R. Halder, Counsel
Discretionary powers in appointments must be exercised judiciously; applicants cannot claim rights based on irregularities affecting others.
Headnote:(A) Railway Recruitment Rules - Discretionary Power of General Manager - The applicants sought to quash the Office Orders dated 15.12.2022 rejecting their appointment as Substitute Group 'D' due to age limits. The Tribunal found that the applicants were overaged as of 10.09.2008, and the General Manager's decision was a well-reasoned speaking order. (Paras 9, 19, 23)
(B) Discretionary Appointments - The court emphasized that discretionary powers must be exercised judiciously and transparently, and applicants cannot claim rights based on others' irregular appointments. (Paras 21, 22)
Facts of the case:
The applicants, included in a list of 303 candidates for Substitute Group 'D' positions, were denied appointments due to being overaged as of 10.09.2008, despite having applied within the permissible age limit in 2005.
Findings of Court:
The General Manager's order dated 15.12.2022 was upheld as a detailed and reasoned decision, dismissing the Original Application.
Issues: The main issues were the validity of the age limit applied to the applicants and the exercise of discretionary power by the General Manager.
Ratio Decidendi: The Tribunal ruled that the General Manager's discretionary power must be exercised fairly, and the applicants' claims were not valid as they were overaged according to the established rules.
Result: The O.A. is accordingly dismissed.
