ORDER

Per Mr. Manish Garg, JM:

The applicant has filed this O.A. under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief:

“(a) To set aside and quash impugned Speaking order No. RSO/KGP/E/Court Case/R. K. Pathak/2019 dated 31.12.2019 issued by Sr. Divl. Electrical Engineer (OP), S.E. Railway, Kharagpur.

(b) To direct the respondents to cause them to act in consonance with Order dated 10.06.2019 in O.A. 271/2013 passed by the Hon’ble Tribunal by appointing applicant as Substitute Bunglow Peon against the immediate available vacancy or alternatively reinstate the applicant in his former post forthwith.

(c) Any other order or orders as the Hon’ble Tribunal deems fit and proper.”

2. Applicant seeks to challenge the impugned order dated 31.12.2019 on the analogy that the speaking order is contrary to the order passed on 10.06.2019 which reads as under:

“8. Neither the source of the post was borne out of record, nor the other characteristics of the probation, confirmation, promotion, etc. attributed to it. We are of the view that the applicant can be considered for fresh appointment as Substitute Bunglow Peon against the first available vacancy, duly denying hi
