ORDER
As per facts of the case as projected in the Original Application (in short O.A.), applicant in the year 2016, while posted as Professor, Department of Forensic Medicine, Government Medical College, Jammu was arrested on 20.12.2016, in a case FIR No. 198 of 2016 of Police Station, Bakshi Nagar, for offence under Section 354 RPC, on the basis of a written complaint lodged by a student of pre-final MBBS GMC, Jammu on the allegation of outraging her modesty. Vide Government Order No. 656-HME of 2017 dated 02.01.2017, the applicant was placed under suspension in terms of Rule -31 (2) of J&K Civil Services (Classification, Control and Appeal) Rules, 1956 and was attached in the Directorate of Health Services, Jammu.
2. In pursuance of departmental inquiry conducted by the then Principal Dr. Nasib Chand Digra, GMC, Jammu, the applicant as per report of inquiry was exonerated of the articles of charges framed against him on the ground that allegations/grievances of the complainant were baseless, false and devoid of any merit. The applicant was also acquitted by the Court of Special Mobile Magistrate, Electricity Jammu vide order dated 20.07.2022 in the aforesaid FIR on the failure of
