1. The present OA has been filed by the applicant seeking following reliefs:
“ 8.1 That your Lordships may graciously be pleased to quash and set aside the impugned Orders dated 24.06.2022 and 16.03.2023 as contained in Annexure-A/1 & A/2 issued by the Respondent No.5 & 4 respectively.
8.2 That Your Lordships may graciously be pleased to declare the order dated 05.01.2018 as contained in Annexure A/2 (a) referred in the impugned order dated 16.03.2023 as un-constitutional, contrary to Article-21 of the Constitution of India and also inapplicable in the case of applicant.
8.3 That your Lordships may graciously be pleased to direct / command the Respondents to release/pay the rest amount of medical re-imbursement amounting to Rs.1033518/- without any further delay with statutory interest.
8.4 Any other relief or reliefs including the cost of the proceeding may be allowed in favour of the Applicant.”
2. Brief facts of the case are that applicant was superannuated from Railway on 31.07.2021 while serving as Chief Office Superintendent, East Central Railway, Darbhanga under Samastipur Division.
