ORDER (ORAL)

PER: RAKESH KUMAR GUPTA, MEMBER (A)

1. The applicant has filed the present Original Application under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:

a) To set aside the order dated 23.8.2021 bearing No. B/P.209/WP- 43548/2015/MECH/C&W (Annexure A-7), vide which the promotion of the applicant at par with his immediate junior Shri Lakshminarasimhaiah, has been revised in compliance of the High Court orders in WP. No.43548/2015, duly granting him seniority w.e.f. 20.9.1991.

b) Direct the respondents to review the claim of the applicant for promotion to the post of Technician grade-II, Technician grade-I and Senior Technician, under reserve quota only, consequently exchange all consequential benefits.

c) Issue such other directions as deemed fit in the circumstances of the case.

2. The facts of the case as pleaded by the applicant in his pleadings, are as follows:

a) The applicant was absorbed as a temporary Khalasi with effect from 31.12.1987. Thereafter he passed necessary suitability test and was promoted as Khalasi helper with effect from 20.09.1991 vide office memorandum dated 29.09.1991. He was discharging his duties as Machinist grade I
