O R D E R
Per: SURESH KUMAR BATRA MEMBER (J):-
1. The present Original Application has been filed by the applicant under Section 19 of the Administrative Tribunals Act 1985 seeking the following relief:-
(i) To quash the order dated 12.9.2019 (Annexure A-1) read with order dated 16.01.2020 (Annexure A-2), 28.07.2021 (Annexure A-3) and 23.11.2021 (Annexure A-4) vide which the child care leave sanctioned by respondents and availed by the applicant qua her third child (who is disabled) for 265 days during the years 2013, 2014 and 2016 has been cancelled retrospectively and she has been asked to apply for leave of the kind due or recovery of approximately Rs.4 Lacs is likely to be made from her which is illegal and arbitrary.
(ii) To declare that since the third child of the applicant who is suffering from mental retardation and needs constant care of the applicant, the applicant is entitled to child care leave for third child also as she had not taken any child care leave for 1st child and the respondents be directed to grant her child care leave for third child also.
