Heard Mr. R Mahanty, learned counsel for the applicant and Mr. A Nageswara Rao, learned counsel for the respondents.
2. By this Original Application the applicant is seeking the following relief(s):
“to direct the Respondents to grant one annual increment which the applicant had earned one day prior to retired, on attaining the age of superannuation i. e 30.06.2016 in the light of the Hon'ble Supreme Court judgment in R.P. (C) No.1731/2019 in SLP (C) No.22008/2018 duly declaring the action of the authorities in not considering the same as illegal, arbitrary and against to the principles of natural justice and also against to denying the same is unjust, arbitrary and discriminatory, and against to the Article 141 & 142 and Art. 14 & 16 of the Constitution of India and pass such other order or orders as this Hon'ble Tribunal may deem fit and proper in the circumstances of the case and oblige.”
3. When the matter is taken up for consideration, the learned counsel for applicant submits that, as per the relief prayed for by the applicant, the issue is no more res-integra and is fully covered by the judgement of the Hon’ble
