Applicant is a former Technician-C in the Regional Medical Research Centre, hereinafter referred to as the Centre, Dollygunj, Port Blair. He had faced disciplinary proceedings under Rule 14 of the CCS(CCA)Rules and ultimately an order of compulsory retirement was imposed on him. The entire proceedings are under challenge in this Original Application filed under Section 19 of the Administrative Tribunals Act .
2. In Annexure-A5 charge memo the following two articles of charges were served on him:
“Article-I On 24th January 2011 at around 4.30 pm the Sri.Hamza while functioning as Laboratory Technician at RMRC, Port Blair, blocked the outlet of wash basin/sink with a plastic measuring cylinder and kept the plastic tray over it and thereafter opened the water tap of laboratory (Room No.111) resulting overflow and flooding of water in the Biotechnology Laboratory, its surrounding area including corridor and the newly constructed Molecular Biology Laboratory, which was a wilful act intended to damage the properties of the Centre including fire accident.
The above act on the part of Shri.A.Hamza, Laboratory Technician amounts to misconduct and is in-violation of Rule 3
