O R D E R

Per: SURESH KUMAR BATRA MEMBER (J):-

1. The applicant has filed the present Original Application under Section 19 of the Administrative Tribunals Act 1985 seeking the following relief:-

(i) To quash and set aside the impugned order dated

16.03.2023.

(ii) To hold the applicant eligible for appointment to the post of M.T.S.

2. The factual matrix of the case is that the applicant applied for the post of Multi Tasking Staff (MTS) under unreserved category pursuant to a notification dated 24.02.2021 issued by respondent no. 3. Vide notice dated 13.04.2022 (Annexure A-4), the applicant was declared successful in the written examination conducted on 26.12.2021 for the selection to the post of MTS in Arid Forest Research Institute, Jodhpur. He submitted duly filled attestation form and identity certificate. Vide letter dated 22.08.2022, the respondent no. 3 informed the applicant that as per the police investigation report there are other case also pending against the applicant apart for the motor accident case mentioned in the attestation form and he was asked to give details of all other pending cases and reason for not disclosing the same.
