CENTRAL ADMINISTRATIVE TRIBUNAL
Shri M.G. Sewlikar, J
Valerie Avinash Dhepe And Ors – Appellant
Versus
Income Tax Department – Respondent
OA | OA 75/2022

Advocates:
For the Appellants/Petitioners: Shri S.J. Kamble
For the Respondents: N/A

The court upheld that reservations in promotions for SC/ST are constitutionally valid under Article 16(4-A), emphasizing the need for a proper review process to ensure compliance with legal mandates.

Headnote:(A) Constitution of India - Articles 16(4) and 16(4-A) - Reservation in promotion - Challenge to the Office Order regarding review DPCs since 1997 exists. Supreme Court established that Article 16(4-A) permits reservation in promotion with consequential seniority for SC/ST if inadequacy is shown. The review process must adhere to the stipulated legal principles, yet the process followed was found compliant with constitutional mandates. Thus, the service of promoted candidates cannot be invalidated merely due to caste verification lapses. (Paras 7, 35, 36, 59)

(B) Reservation policy - The constitutional validity of reservation in promotion allows candidates from reserved categories to apply for non-reserved positions. Efficiency of administration is maintained when promotions align with merit, ensuring fair representation. The decision further emphasized the legislative intent to provide protection to SC/ST individuals in public service without compromising the overall framework of equality and justice. (Paras 129, 60)
