Heard Mr. KRKV Prasad, learned counsel for the applicant and Mrs. K Rajitha, learned counsel for the respondents in OA/208/2024. None for the applicant and Mrs. K Rajitha, learned counsel, appears for the respondents in OA/408/2021. The same applicant filed these two (02) OAs, seeking reliefs, which are inter-related. As such, both the OAs’ were taken up for hearing together and a common order is being passed.
2. By OA/408/2021, the applicant sought the following relief(s):
“…(i) to call for the record relating to the impugned Charge Memorandum no. CIPET/HO/Memo/VKK/Hyd-2021, dated 30.03.2021 and quash and set aside the same and declare the same as illegal, arbitrary, without jurisdiction and against the principles of natural justice and in violation of Article 14, 16 and 21 of the Constitution of India and also the Rules framed under the Conduct, Discipline and Appeal Rules of CIPET and also CCS (CCA) Rules and consequently direct the Respondents to consider the written statement submitted by the Applicant dated 27.04.2021 and drop the proposed enquiry pursuant to the Charge Memorandum no.CIPET/HO/Memo/VKK/Hyd-2021
