ORDER
By Hon’ble Mr. Rajinder Kashyap, Member (A):-
The applicant has filed present Original Application under Section 19 of the Administrative Tribunals Act ., seeking the following relief(s):-
“To quash and set aside order dated 25.10.2022 whereby the extreme punishment of dismissal from service is inflicted upon the applicant by invoking the power under Art. 311(2)(b) of Constitution of India and the order dated 23.02.2024 whereby the statutory appeal of the applicant has been rejected and to further direct the respondents to reinstate the applicant back in service with all consequential benefits including seniority and promotion and pay and allowance.
And/or Any other relief that this Hon’ble Court deems fit and proper may also be awarded to the applicant.”
2. Pursuant to the notices, the respondents have filed their counter affidavit opposing the claim of the applicant and have prayed for dismissal of the present Original Applicant. The applicant has also filed his rejoinder denying the contentions of the counter affidavit and reiterated his claim in the OA.
3. The brief facts of the present case are that the applicant was initially appointed as Constable in Delhi Police in the
