CENTRAL ADMINISTRATIVE TRIBUNAL
Rashmi Saxena Sahni, A
Ajit Kumar Thakur, IFS – Appellant
Versus
Union of India – Respondent
Original Application No. 63/187/2023
For the Appellants/Petitioners: Sh. R. K. Sharma
For the Respondents: Sh. K.K. Thakur, Sh. B.B.Sharma
No stepping up of pay is permissible for senior officers if juniors’ pay is higher due to different rules, emphasizing pay protection over parity.
Headnote:(A) Central Administrative Tribunal - Pay anomaly - Pay fixation - Applicants sought stepping up of pay vis-a-vis junior - Four-tier pay structure implemented affecting IFS pay scales - Court emphasizes no automatic stepping up if junior draws higher pay due to separate rules - Applicants did not merit stepping up as their junior in different cadre benefitted from pay scheme, hence no anomaly existed. (Paras 4, 12, 17, 20)
(B) Pay Protection - Court clarifies concept of pay protection for officers in different cadres - Dismissal of OA as claim for parity of pay not justified based on disparity between State service and IFS rules. (Paras 19, 20)
