For the Respondents: Sri M. Chanda, Smt. U. Dutta, Dr. G.J. Sharma
Retrospective rule changes cannot divest vested promotion rights after selection process completion and joining post.
Headnote:The judgment addresses BSNL Management Services Recruitment Rules (MSRRs-Telecom), 2023 and empanelment guidelines dated 20.04.2023 for Chief General Manager (CGM) posts. Essential facts involve an officer's empanelment, posting as CGM on 15.07.2024 after selection pursuant to notice dated 25.01.2024, followed by reversion via order dated 19.07.2024 without hearing, prompted by revised guidelines dated 22.07.2024 based on DoT directions dated 20.06.2024. Court finds retrospective application of new guidelines arbitrary, violating acquired rights post-selection and joining. Key issues: Whether reversion post-empanelment and joining via subsequent guidelines is valid; if prior interim order staying reversion should continue. Ratio: Amendments altering benefits accrued under existing rules cannot operate retrospectively, as held in precedents; selection process exhaustion protects rights under Arts. 14 & 16; balance of convenience favors original applicant. M.A. dismissed; interim order dated 30.07.2024 in O.A. No. 182/2024 upheld.

No. 182/2024 suspending the operation of the impugned Order of reversion of the sole respondent dated 19.07.2024 as well as Order dated 13.08.2024 passed in this M.A., whereby the prayer for vacating the ex-parte Interim Order dated 30.07.2024 had not been finally considered and disposed of by this Tribunal. 6. It is also the case of the respondent/petitioner in O.A. that he was singled out whereas other similarly situated persons are holding the post.
