ORAL ORDER PER: HON’BLE DR. LATA BASWARAJ PATNE, JUDICIAL MEMBER

1. By this Original Application, the applicants are seeking the following reliefs:-

“To call for the records pertaining to letter dated 30.09.2021 received by Pundit Deen Dayal Upadhya Division in the matter of Inter Railway Request Transfer of the applicants from Guntakal Division and declare the action of the respondent Guntakal Division in not relieving the applicants as illegal, arbitrary, unjust, discriminatory and direct the respondent Guntakal Division to relieve the applicants to Pundit Deen Dayal Upadhya Division forthwith, with a further direction to respondents to grant all consequential benefits to the applicants.”

2. When the matter is taken up for consideration, learned counsel for the respondents fairly submitted that out of five applicants, three applicants have already been relieved, however, two applicants are remained to be relieved. As the respondent department is following the seniority, the two applicants namely Sri Harendra Kumar Singh and Sri Krishna Dhari Kumar (3^rd & 4^th applicants) who are still remained to be relieved are at Sl.No.08 and 32 as per the priority maintained in the Division. It is submitted that as and when their turn comes, they will be relieved as per their request.

3. In view of the above, the respondents are directed to consider the request of the two applicants namely Sri Harendra Kumar Singh and Sri Krishna Dhari Kumar to relieve them to Pundit Deen Dayal Upadhya Division from Guntakal Division on Inter Railway Request Transfer, within a period of three(3) months from the date of receipt of this order.

4. The OA is disposed of with the above observation. No order as to costs.
