For the Respondents: Sri A. Chakraborty, Addl. CGSC for R.Nos. 1 to 4

Dismissal penalty shockingly disproportionate for procedural lapses without financial loss; lesser punishment mandated.

Headnote:Under CCS (CCA) Rules, 1965 (R.14, R.15(1)) and CCS (Conduct) Rules, 1964 (R.3(1)(i),(ii),(iii),(iv)), applicant AAO faced charges for irregular bill processing, overpayments, and supervisory lapses in Defence Accounts. Essential facts: promotions from 1995, irregularities noted 2014, chargesheet 17.05.2017, dismissal imposed, appeal rejected 28.03.2018. Court found no financial loss caused. Key issues: procedural compliance in disciplinary inquiry, proportionality of dismissal penalty. Ratio: no disagreement stated by DA under R.15(1) for further inquiry; similar co-accused case (O.A.425/2018) quashed dismissal for disproportionality despite lapses, affirmed by High Court. Impugned orders dated 12.08.2016, 17.05.2017, 28.03.2018 quashed; reinstate applicant, impose lesser punishment proportionate to lapses, excluding dismissal, within 4 months.
