Versus
Union of India – Respondent
OA No. 174/2021

Advocates:
For the Appellants/Petitioners: Mr. A.L. Sharma
For the Respondents: Ms. Maithili D Mehta

The court emphasized the necessity of re-evaluating the applicant's pay scale claims, distinct from previous orders, ensuring due process as warranted by the Administrative Tribunals Act.

Headnote:(A) Administrative Tribunals Act, 1985 - Section 19 - Pay fixation - The applicant challenged the Revised Pay Fixation Order which reduced his pay and led to recovery from his gratuity. (B) Jurisdiction of the Supreme Court - The Supreme Court's decision prohibits Data Entry Operators from claiming higher pay solely based on qualifications, hence, the department complied with its directives. (Paras 3.1, 3.2)

Facts of the case:
The applicant was initially placed in a higher pay scale but faced a reduction as per the Supreme Court's ruling that denied pay increases based on qualifications alone.

Findings of Court:
The Tribunal grants the applicant liberty to file representation regarding his pay scale and directs respondents to decide promptly without influence of prior decisions.

Issues: The questions addressed include the validity of pay reduction and applicability of the Supreme Court's order to this case.

Ratio Decidendi: The Tribunal emphasized the necessity for a fresh examination of the applicant's pay claim, separating it from previous binding orders.
