Shri K. C. Vishwakarma, learned counsel for the applicant and Shri Chakrapani Vatsyayan, learned counsel for the respondents are present.
2. The instant Original Application has been filed by the applicant with a prayer to fix the pension with one Additional th Notional Increment, alongwith all consequential benefits w.e.f. 30 June of the year in which he retired from government service. In this regard, the applicant has submitted his representation on 25.07.2024 to the respondent no.4/competent authority, i.e.
Senior Personnel Officer, N.C. Railway, (Workshop), Jhansi.
3. Learned counsel for the applicant submits that his grievance may be redressed if a direction is given to the respondents to consider and decide the pending representation dated 25.07.2024 (Annexure-11) of the applicant by passing a reasoned and speaking order within a time bound manner.
4. On the other hand, learned counsel for the respondents submits that he has no objection if such direction is issued to decide the representation of the applicant as per rules.
5. In view of the limited prayer made by learned counsel for the applicant, no fruitful purpose will be served in keeping this original application pending. Accordingly, the competent authority amongst the respondents is directed to decide the said representation dated 25.07.2024 (Annexure-11) of the applicant in the light of existing rules and regulations within a period of three months from the date of receipt of a certified copy of this order.
The order so passed shall be communicated to the applicant without any delay.
6. With the above direction, the original application no.1503 of
2024 is disposed of. No order as to costs.
7. It is made clear that I have not entered into the delay, latches and merit of the claim of the applicant. All points are open for consideration by the respondents.
8. Pending M.A., if any stands dispose of.
