ORDER

The instant Original Application has been filed by the applicants under Section 19 of Administrative Tribunals Act , 1985 making therein the following reliefs: -

“i. Set aside and quash the communication bearing reference No. FD-ADM/37/2022-03 dated 11-05-2022 issued by the Respondent No. 4 and the communication bearing No.DGAT/E/111/Sgr/57 dated 04.04.2022 issued by the Respondent No. 5 whereby the applicant has been denied the consideration of appointment against the post of Accounts Assistant in the Divisional Cadre Kashmir in pursuance to the selection process initiated vide Advertisement Notice No. 01 of 2012 dated 19.07.2012;

ii. Direct the respondent No. 4 and 5 to consider the applicant for appointment against the vacant post of Accounts Assistant in Divisional Cadre Kashmir by further operating the wait list issued in pursuance to the selection process initiated vide Advertisement Notice No.01 of 2012 dated 19-07-2012.”

This matter has been referred to me as the Third Member in view of a difference of opinion between the Hon’ble Judicial Member and the Hon’ble Administrative Member regarding the entitlement of the applicant to appointment against a post under the PM Pac
