O R D E R (ORAL)
Per : Hon’ble Shri Jayesh V. Bhairavia, Member (J) 1. Mr. Joy Mathew, counsel for the applicant present.
2. On receipt of the notice issued by this Tribunal, Advocate Mr.
Shashikant Gade appears for the respondents and prays for short time to file vakalatnama and reply.
3. Counsel for the applicant fairly submits that being aggrieved with the order passed by this Tribunal in O.A.370/2014 the original respondents have approached Hon'ble High Court of Gujarat by way of SCA No./13428/2024 and vide order dated 17.10.2024 stay has been granted against the order passed by this Tribunal.
4. On the other hand, counsel for the respondents submits that he has not received any instructions about the grant of stay in the SCA No./13428/2024 filed by the respondents.
5. Heard counsel for the parties and perused the material available on record.
6 It can be seen that the Hon’ble High Court of Gujarat has seized the matter and vide order dated 17.10.2024 stay has been granted in respect of order passed by this Tribunal in O.A.370/2024. Therefore, admittedly the order that will be passed by the Hon'ble High Court would be binding on both the parties. Therefore, at this stage we are not inclined to entertain the C.P.
7. In view of the above, the present Contempt Petition stands dropped.
