Per: Hon’ble Smt. Urmita Datta (Sen) (J): 1. Ld Counsel for the applicant is present.
2. Ld Counsel Mr. P Bhattacharya appears for the respondents. He files his memo of appearance which is taken on record.
3. Heard.
4. The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985, praying for the following relief(s):-
“a) A direction do issue upon the Respondents Authorities, specifically, the Post Master General, South Bengal Region and the Senior Superintendent of Post Offices, Midnapore Division being the Respondent No.- 4 & 5 herein to Release and Disburse the Arear of Pay for the period from 01.01.2006 to 31.01.2015/ 28.02.2015 in terms of the Memorandum being No. 2-53/2011 PCC, dated 22.01.2015 issued by the Assistant Director General (GDS/PCC), Government of India, Ministry of Communications, Department of Posts to the Applicant forthwith;
b). A direction do issue upon the Respondents Authorities, specifically, the Post Master General, South Bengal Region and the Senior Superintendent of Post Offices, Midnapore Division being the Respondent No.-4 & 5 herein by considering the Representations, dated 19.07.2024 and 23.08.2024 submitted by the Applicant herein to Release and Disburse the Arear of Pay for the period from 01.01.2006 to 31.01.2015/28.02.2015 in terms of the Memorandum being No. 2- 53/2011-PCC, dated 22.01.2015 issued by the Assistant Director General (GDS/PCC), Government of India, Ministry of Communications, Department of Posts to the Applicant forthwith;
c). A direction do issue upon the Respondents Authorities, specifically, the Post Master General, South Bengal Region and the Senior Superintendent of Post Offices, Midnapore Division being the Respondent No.- 4 & 5 herein to Pay interest @ 10% p.a. for delayed Payment of Arear of Pay in terms of the Memorandum being No. 2-53/2011- PCC, dated 22.01.2015 issued by the Assistant Director General (GDS/PCC), Government of India, Ministry of Communications, Department of Posts till the date of actual Disbursement;
d). A direction do issue upon the Respondents Authorities to certify and transmit all Records pertaining to the instant Original Application so that a Conscionable Justice may be administered;
e). And to pass such other or further Order and/or Orders as to your Lordships may deem fit and proper.”
