O R D E R

Per: - Sh. Rajinder Singh Dogra, Judicial Member The instant petition was initially filed before the Hon’ble High Court of Jammu and Kashmir, and later on it was transferred to this Tribunal, and the petitioner had sought the following reliefs: -

“i. Certiorari: Quashing the consideration order no.

Estab./22/10910-11 dated 17.08.2022 passed by the respondent by which the respondent without properly considering the case of the petitioner for compassionate appointment has rejected the same in an arbitrary manner;

ii. Mandamus: Directing the respondent to appoint the petitioner Under SRO 43 on Compassionate Grounds being the adopted son of the Late Sh. Devinder Singh Raina who died in harness on 30.01.2017;

iii. Mandamus: Commanding the respondent to consider the case of the petitioner for compassionate appointment under SRO 43 of 1994.” 2. Facts of the case, in brief are: -

The petitioner has invoked the jurisdiction of this Court, seeking the quashing of order No. Estab/22/10910-11 dated 17.08.2022, whereby his request for compassionate appointment under SRO 43 of 1994 has been rejected. The petitioner claims entitlement to such appointment as the “adopted son” of the RAJAT SING
