Having regard to the short controversy involved in the present matter and since the pleadings are complete, we propose to dispose of the present OA.
2. The brief facts involved in the present case are as follows:
In the year 2006 an anonymous complaint was received by Central Vigilance Commission (CVC) against the applicant. The respondent, i.e., Central Board of Secondary Education (CBSE), therefore, issued a chargesheet with two articles of charge against the applicant on 24.06.2019. The inquiry report was submitted by the inquiry officer on 27.05.2021 and thereafter, the Chairman, CBSE passed the order dated 31.12.2021 under which the applicant was compulsorily retired from service. The said order of the Chairman, CBSE was challenged by the applicant by filing an appeal before the Secretary, School Education (Appellate Authority) under Rule 9.17 of CBSE Service Rules, 1985
