Challenging the legality of clause 5 (v) & (vi) of “Casual Labourers (Grant of Temporary Status and Regularization) Scheme of Government of India, 1993” [hereinafter referred to as Regularization Scheme of 1993 ], the applicants have prayed to direct the respondents to grant them pensionary benefits under CCS (Pension) Rules, 1972 alongwith consequential benefits as admissible to a Group ‘D’ regular employee.
Since questions involved in these OAs are identical based on the same facts and law, the same are being decided by this common order.
2. The facts necessary to adjudicate these OAs are as under:-
2.1 The applicant (Mr Bishun) in OA No. 238/2014 was initially engaged as Cattle Farm Attendant in Central Cattle Breeding Farm (CCBF) at Suratgarh in December, 1979. As per Regularization Scheme of 1993 , vide order dated 25.12.1994 (Annex. A/4), he was granted temporary status w.e.f. 01.09.1993. His pay was fixed as per CCS (Revised) Pay Rules from time to time.
